Terms

Terms of service

The terms for using this website and for buying services and products from Identity Cultural Projects.

Last updated: 28 October 2026

About these terms

These terms apply when you use identityculturalprojects.com or buy a service or product from Iain Dawson, trading as Identity Cultural Projects (“I”, “me”). By making a booking or purchase, you agree to them. For larger projects I may also send a written proposal or agreement; if it differs from these terms, the written agreement applies.

Nothing here limits your consumer rights

Our goods and services come with guarantees that cannot be excluded under the Australian Consumer Law. Nothing in these terms removes or limits those rights.

How I work with your money

I never hold, receive or manage client funds. Grants are paid directly to you, artwork sales are invoiced and received by you, and exhibition hire fees are paid by venues directly to you. I’m paid only my own fees, as set out below.

Studio Operations Retainer

  • The retainer is billed monthly in advance, automatically, by card or direct debit through Stripe.
  • There is a three-month minimum. After that, it continues month to month.
  • You can cancel at any time after the minimum by giving 30 days’ notice by email to hello@identityculturalprojects.com. Your final payment covers the notice period.
  • The founding client rate is fixed for your first 12 months. After that, the standard rate applies unless we agree otherwise in writing, and I’ll give you at least 30 days’ notice of any change.
  • The work included each month is described on the Artist Services page. Unused hours or tasks don’t roll over to the next month.
  • If a payment fails, Stripe will retry it and email you. If it remains unpaid, I may pause work until it’s resolved.

Funding applications and projects

  • Fees are fixed and quoted in writing before work begins.
  • Unless the quote says otherwise, I invoice 50% to start and 50% on completion, payable within 14 days.
  • You review and approve each application and submit it in your own name. You’re responsible for the accuracy of the information you provide and for meeting the funder’s eligibility rules and deadlines.
  • I can’t guarantee that any grant, prize, exhibition, sale or opportunity will be successful. Decisions are made by others.
  • For funding applications, please book at least four weeks before the deadline.
  • If you cancel a project after work has started, you pay for the work completed to that point.

Practice Review

  • A Practice Review is a single 90-minute session, paid in advance, followed by a written action plan within five working days.
  • You can reschedule with at least 24 hours’ notice. Sessions missed without notice aren’t refunded.
  • If you join the Studio Operations Retainer within 30 days of your session, the full fee is credited against your first month.

Collection Review and Collection Advisory

  • A Collection Review is a single two-hour session, paid in advance, in person or by video, followed by a written report within ten working days.
  • In-person reviews cover the Northern Rivers and the Gold Coast. Travel further afield is quoted and agreed before booking.
  • You can reschedule with at least 24 hours’ notice. Sessions missed without notice aren’t refunded.
  • My advice is not a formal valuation. Valuations for insurance, sale or the Cultural Gifts Program must come from an appropriately qualified or approved valuer, and conservation treatment from an accredited conservator. I can recommend and brief them.
  • Collection Advisory is quoted in writing for each collection. You pay galleries, auction houses, valuers and other specialists directly.
  • I am paid only by my clients. I don’t accept commissions, referral fees or other payments from galleries, dealers or auction houses for works my clients buy.

Downloadable kits

  • These terms apply to the Touring Proposal Kit, the Approaching Commercial Galleries Kit and any other downloadable kit I sell.
  • The kit is a digital download, delivered immediately after payment by a download page and by email.
  • The kit is licensed, not sold. A personal purchase lets you use the templates for your own exhibitions. An organisation licence lets your organisation’s staff use them across your exhibitions. You may not resell, share publicly or redistribute the files.
  • Because the kit is delivered instantly, I don’t offer refunds for change of mind. If a file is faulty or the kit isn’t as described, email me and I’ll replace it or refund you.
  • For the kit plus review, send your completed proposal and budget to hello@identityculturalprojects.com within 12 months of purchase. You’ll receive written feedback within ten working days.
  • If you buy the kit or the kit plus review and then book the full touring service, the amount you paid comes off the full service fee.
  • The kit and its worked example are general guidance, not legal, financial or insurance advice.

Your materials and my work

You keep all rights in your artwork, images and materials. You give me permission to use them only to do the work you’ve asked for.

Once you’ve paid in full, you own the written work I produce for you (such as statements, proposals and applications). I may describe the project in general terms in my portfolio, and will only name you or show your work with your permission.

Confidentiality

I keep your information, plans and unpublished work confidential, except where you’ve agreed I can share them or the law requires me to.

Liability

To the extent the law allows, my total liability for any claim relating to a service or product is limited to the fees you paid for it, and I’m not liable for indirect losses such as lost sales or opportunities.
